Insolvency Services
The revised Law on Rehabilitation and Bankruptcy of Enterprises of Lao PDR was issued in 2022, according to Article 35 (Improved) Rights and Duties of insolvency Administrator. An administrator shall have the following rights and duties:
- To inspect, gather and make a list of all the assets of the debtor enterprise;
- To make a summary all accounts payable and receivable of the debtor enterprise and maintain a list of all the creditors, debtors and the amounts payable and receivable of the enterprise;
- To examine the financial status of the debtor enterprise and make a report to the court and the meetings of creditors;
- To assist the debtor enterprise in coordinating, drafting and negotiating the proposal for the settlement of debts with creditors for the rehabilitation of SMEs;
- To give opinions on the rehabilitation plan or prepare the rehabilitation plan as requested by the debtor enterprise or creditors including assistance in finding funding sources used for the rehabilitation;
- To monitor and inspect the business operations of the debtor enterprise or undertake the administration, management of the debtor enterprise in the case of the creditors having no trust in the Executive Officer of the debtor enterprise until a new Executive Office is appointed;
- To decide on the use of assets and expenses of the debtor enterprise based on the plan approved by the court;
- To examine the creditors’ claims and value such claims;
- To create a plan for the liquidation of the assets and debts of the debtor enterprise in the bankruptcy case;
- To propose to the court to issue interim measures for protecting the assets of the debtor enterprise;
- To call and prepare for creditors’ meetings;
- To make periodic report of its activities to the court and to creditors’ meetings;
- To perform other rights and duties as prescribed by law.
